The administration's invocation of the War Powers Act to justify new military strikes without congressional approval is an attempt to bypass the law.

“one of the ways that the administration tried to get around that was by saying by notifying Congress that this is a new war and so they get another 60 days under the War Powers Act”

The War Powers Act should be invoked to limit the President's ability to conduct kinetic attacks in the Caribbean without congressional authority.

“our our resolution would say no, it is and you've got to get authority from the Congress to continue uh with your kinetic attacks in the Caribbean.”

He claims that the failure of the War Powers Resolution means that Congress is failing to retain its authority and stop unauthorized unilateral military actions by Donald Trump.

“And that vote means that Congress has opted not to retain its own authority as it relates to this exceedingly unpopular war with Iran.”

The current military operations in Iran violate the War Powers Act because the authorized 60-day window has expired without Congressional authorization.

“Today is not just May Day. It is 60 days. It's 60 days since the war in Iran started. Technically, technically, they should be going to Congress for a war powers resolution and seeking support for the war cuz the the time has run out.”

Congress must use its constitutional power to end the war and insist on its role in the checks and balances system.

“And if we don't use that power to bring an end to this war, if we don't use that power to insist that Congress play its role in our system of checks and balances, then that power is gone for good.”

Congress has a clear constitutional duty to authorize wars, and its failure to do so while the executive branch initiates conflicts is a dereliction of duty.

“if you follow the constitution, it is not unclear who should declare war. It is crystal clear. Congress declares war.”

Congress must reclaim its constitutional authority to declare war rather than delegating it to the executive branch.

“And we work with anybody that's anti-war and proconstitutional war powers that we get the power back out of the executive branch into Congress where it belongs.”

The executive branch has historically resisted the War Powers Act by arguing that it does not apply or is not fully legal.

“But the executive branch has always been resistant to it and always kind of argued either that it doesn't apply or it isn't fully legal or they're providing information but they don't have to.”
