Dick Harpootlian went on national television and told the country his team has a strategy for the kennel video. That’s the one piece of evidence that destroyed Alex Murdaugh’s alibi the first time — audio of his voice at the Moselle kennels minutes before his wife and son were shot to death. Multiple witnesses identified him under oath. He admitted he lied about being there. The jury convicted in under three hours. Now the defense says they can counter it. But the prosecution has its own problem. The South Carolina Supreme Court told Creighton Waters that twelve and a half hours of financial crimes testimony was excessive and prejudicial — and the retrial has to look completely different. The motive narrative that carried the first conviction has been sharply curtailed. The defense is pointing to unknown male DNA under Maggie’s fingernails that was never run through CODIS. They filed a federal lawsuit against Becky Hill that gives them sworn deposition tools the criminal case doesn’t provide. Both sides are rebuilding from the ground up. The defense thinks the kennel video can be beaten. The prosecution has to prove murder without the financial wreckage that told the jury why. One of those strategies will fail.
