Lindsay Clancy’s mistrial left Plymouth County DA Tim Cruz with a decision that could define the next phase of the case. Kevin Reddington says the jury split 11-1 for acquittal, yet Cruz stood outside court and described the deaths as the “cruel and calculated killing of three innocents.” Judge William Sullivan declared a mistrial on September 4 after seven days and more than 38 hours of deliberation. The defense argued postpartum psychosis left Clancy without criminal responsibility. Prosecutors argued she understood her actions and retained control. Cruz said afterward that the evidence suggested to his office that she was in control when the children died. That leaves a hard legal question and a hard human one.
