The Indiana Attorney General just told the appeals court that the case against Richard Allen is "conclusive and irrefutable." They filed a 94-page brief arguing every ruling was correct, every confession was voluntary, and every defense objection was harmless error. They never once addressed the fact that the man who confessed told his prison psychiatrist he shot the girls. Abby Williams and Libby German were not shot. This week's look back at the most compelling stories in true crime breaks down what the State is arguing — and what they're choosing not to say. According to the defense's appeal brief, Richard Allen's confessions contained a fundamental factual error about how the victims died. The State's response calls those confessions credible, voluntary, and the product of free will. It never reconciles that claim with a confessor who allegedly got the cause of death wrong. The brief also doesn't engage with the composite sketch witness Betsy Blair, who reportedly rated her identification a perfect ten — depicting a man in his twenties with curly hair. The jury never saw it. It doesn't address the bullet comparison that, according to trial testimony, initially came back without a match before a different methodology was applied. It doesn't explain why prison videos of Allen's documented deterioration were played muted at trial — so jurors could see his condition without hearing a word he said. And it doesn't account for surveillance footage that, according to the defense, shows the van that allegedly corroborates Allen's confession arriving significantly later than the State's witness testified. Every one of these issues gets the same answer: harmless error. Even if we got it wrong, the evidence was overwhelming. Nothing would have changed. Defense attorney Bob Motta joins for a full three-part panel examining the State's strategy, the two factual problems the brief can't solve, and what comes next — the defense reply brief, the possibility of oral arguments, and what a partial win means for a man serving 130 years in an Oklahoma prison. The appeal is active. This case is not over. Join Our SubStack For AD-FREE ADVANCE EPISODES & EXTRAS!: https://hiddenkillers.substack.com/ Want to comment and watch this podcast as a video?
