Bryan Kohberger went silent for three and a half years. When he finally spoke, in a handwritten petition and a public statement, he called his case "a work of fiction," invited the state to seek the death penalty again, and thanked the people who believe in his innocence. He mentioned the public. He mentioned his family. He mentioned his supporters. He never once said the names Kaylee, Madison, Xana, or Ethan. Psychotherapist Shavaun Scott goes through that statement line by line — the framing that makes Kohberger the wronged party, the line "my actual innocence is my truth," and an affidavit accusing his own lawyers of telling him guilt wasn't an important factor. Then reporters found where some of his language actually came from. The phrase "broken plea" is the title of a true crime book. The term "clumps of hair" he cites as proof of his innocence appears in no court filing or police record — only in that book. His own defense team once sent a cease-and-desist letter trying to suppress it. And according to PEOPLE, a DNA expert his own defense hired already tested that hair and found it consistent with Ethan Chapin's own. Criminal defense attorney Bob Motta of Defense Diaries breaks down whether a petition built partly on a book can survive judicial scrutiny, what it means that Kohberger answered "yes" under oath confirming his plea was voluntary, and why Steve Goncalves — the father who fought this plea deal the hardest — now welcomes a retrial and says the family will pursue the death penalty. Tony Brueski hosts both conversations, unpacking what Kohberger said, what he borrowed, and what he left out entirely. #BryanKohberger #IdahoStudentMurders #HiddenKillers #ShavaunScott #BobMotta #DefenseDiaries #EthanChapin #BrokenPlea #KohbergerCase #TrueCrime Join Our SubStack For AD-FREE ADVANCE EPISODES & EXTRAS!: https://hiddenkillers.substack.com/ Want to comment and watch this podcast as a video?
