Alex Murdaugh testified in his own defense back in 2023. Now prosecutors want a brand new jury to hear every word of it. Tony Brueski and retired FBI Special Agent Robin Dreeke take listener questions on what that filing actually means for the retrial. That 2023 testimony includes Murdaugh's admission that he lied to investigators for about eighteen months about being at the kennels the night Maggie and Paul were killed. It also includes his denial of the killings themselves. Prosecutors are renewing two motions the state won ahead of the first trial: one keeping third-party guilt evidence away from the jury, the other barring any reference to a polygraph, after Murdaugh's own attorneys once told a court that Curtis Eddie Smith failed one when asked about the murders. Prosecutors are also pushing for a fresh review of digital evidence while opposing the defense's request for independent DNA testing. The defense isn't sitting still either. A new supplemental Brady and Giglio motion demands prosecutors search again for favorable evidence generated since the first trial and certify in writing, within thirty days, that nothing was missed. Ten categories are listed, and the motion names no specific witness or document. A sanctions motion from the first trial is still outstanding, and the state hasn't responded yet. Dreeke works through what a second trip to the witness stand would actually look like for Murdaugh, and why a man who's talked his way through every other room might want one now. Judge Debra McCaslin has tentatively set the retrial for April 5, 2027. Murdaugh is presumed innocent.
