Lindsay Clancy's mistrial now has a second fight layered over the first. Her defense wants Judge William Sullivan to examine whether the lone holdout juror gave truthful answers before trial and whether he used his cellphone during deliberations. Public records reported after the mistrial show that Michael Desronvil had a dismissed domestic assault case, was facing eviction, and was subject to a civil restraining order when he was selected for the jury. That matters because Massachusetts' confidential juror questionnaire asks about arrests, criminal charges, court orders, lawsuits, and other experiences with the legal system. Kevin Reddington's motion asks the court to review the sealed questionnaire, the jury-selection process, and phone activity during deliberations. As of September 23, the court has impounded related materials but has not publicly ruled on the requested inquiry. A September 29 hearing is scheduled. The legal fight lands days after Patrick Clancy's 60 Minutes interview put a very different kind of hidden information at the center of the case. Patrick said mental illness can be 'tragically deceptive' and acknowledged there were things he did not see while Lindsay was deteriorating. CBS reported that she checked herself into McLean Psychiatric Hospital on New Year's Eve, was treated for depression, and returned home days later. When Patrick later asked whether she remembered January 24, he said Lindsay described it as being like a dream. The defense has also moved to dismiss the case on double-jeopardy grounds, arguing Judge Sullivan did not sufficiently explore alternatives before declaring the mistrial.
