She was fourteen. She had braces. She weighed seventy-one pounds when her dismembered remains were found inside a Tesla registered to the singer known as D4vd. And when his defense team finally spoke, they didn't just say he was innocent. They said two very specific things — that David Anthony Burke "did not murder Celeste Rivas Hernandez and he was not the cause of her death." That is not one denial. That is two separate legal claims. And according to trial attorney and former felony prosecutor Eric Faddis, that language tells you everything about the defense strategy being built right now. Burke, 21, faces first-degree murder with special circumstances that put the death penalty on the table — continuous abuse of a minor under fourteen, and mutilation of remains. Prosecutors allege he ended Celeste's life to protect a music career she reportedly threatened to expose. They say they have over forty terabytes of digital evidence, a wiretap, and exploitation material allegedly recovered from his phone. The unsealed autopsy confirmed Celeste died from penetrating wounds to her torso. Her body had been dismembered. But here is what prosecutors don't have — a grand jury indictment. Despite convening three separate grand juries over the course of the investigation, none produced charges. The DA filed a criminal complaint instead. Defense attorney Blair Berk made sure everyone in that courtroom knew it — and then pushed for a preliminary hearing within ten court days. Faddis explains why that move matters, what it signals about Berk's confidence, and whether the financial-gain special circumstance can survive when the allegation is about protecting income someone already had. Retired FBI Counterintelligence Behavioral Analysis Program Chief Robin Dreeke takes listener questions on the year-long gap between Celeste's disappearance and Burke's arrest, who failed this child, and what the sheer volume of sealed evidence tells us about what has not yet been made public. Celeste was reported missing three separate times before she was gone for good. Someone should have been paying closer attention. Burke has pled not guilty. His attorneys say the evidence will prove his innocence.
