Alex Murdaugh's defense team spent three hours at an August 14 pretrial hearing winning motion after motion — then saved the biggest claim for last. Lawyers told Judge McCaslin that weapons recovered in a recent Allendale County homicide may share a ballistics link to the firearms from the Moselle killings. Prosecutor Creighton Waters, who says he talks to SLED every day, told the court he'd never heard of it. Retired FBI Special Agent Jennifer Coffindaffer joins Tony Brueski to break down the entire hearing. McCaslin pulled the retrial completely outside the 14th Judicial Circuit, pointing to the impossibility of seating an unbiased jury in a county where Murdaugh's family ran the local prosecutor's office for three generations. She cleared the way for independent lab testing on unidentified male DNA found under Maggie Murdaugh's fingernails, after the defense argued SLED's own retesting method would destroy the sample. She ruled the state can replay Murdaugh's 2023 sworn testimony for the new jury — including his admission that he lied about being at the kennels the night his wife and son were killed. And she's now personally overseeing how jurors are summoned, after questions surfaced about whether court official Becky Hill's interference in the first trial started before deliberations even began. Murdaugh's team has also asked the judge to void the murder charges entirely, alleging SLED's lead agent fabricated evidence for the grand jury. That motion is still pending.
