That's the confession Indiana is relying on — and it doesn't match how the victims actually died. Three judges at the Indiana Court of Appeals are now sitting on the full record, and what's in it raises more questions than the trial ever answered. Indiana's response brief does something a response brief almost never does — it refuses to fight on the facts. The defense raised a van timeline contradicted by FBI cell data and surveillance footage. They raised an alternative suspect whose interview was allegedly recorded over by investigators, whose weapon was never collected, whose phone was never searched. Indiana's answer to most of it: waiver, procedure, harmless error. Filed wrong. Argued too late. When a prosecution defending a 130-year sentence won't engage with the actual evidence, the question becomes what's in that record they'd rather three judges never read. Defense attorney Bob Motta walks through the State's procedural strategy and what it signals. He gets into the jailhouse calls — one played for the jury, two excluded, including the call where Allen asked his own father how much longer he could stay lucid.
