The arrest of Don Lemon for reporting at a protest violates his rights as a member of the press.

Hasan maintains that filming public buildings is a legally protected activity under the First Amendment.

Don Lemon's actions are protected by the First Amendment because he was performing the function of a journalist, regardless of whether he was at a traditional news organization.

“If you just look at what he did, yes, the video in the car shows that he knew that there there was going to be a protest, that he knew it was going to be in a church. He had clearly been in some sort of communication or received some sort of tip, but journalists get tips all the time.”

Using whistles during protests to alert others to the presence of ICE agents is a form of expression protected by the First Amendment.

“Physically intervening with ICE activity or obstructing justice is illegal, but whistles are considered a protected form of free speech.”

Andrew Sheets believes that documenting government activities with a body camera is essential for holding officials accountable and securing potential legal evidence.

“I'm not one of the guys that goes in there with a you know camera right in their face uh like I said what I would do is I would go in and I would ask for records and I would document it with the body camera handsfree uh because I you know I don't know if you know or not with Florida records law here”

Criticizing the president through a seashell photo does not rise to the level of an actionable threat and is protected expression.

“it'll take a whole year for them to figure out that I have a First Amendment right and expression to criticize the occupant of the White House and it doesn't rise to the level of a threat of violence or death against the president of the United States.”

While he does not believe Don Lemon should be charged, protest actions that involve screaming at and intimidating families and children in a place of worship are not protected peaceful activity.

“You got kids screaming, you're following people to their cars. It is 100% peaceful. But in any case, putting putting that aside, right, I think if you are upset about people going into a church to protest peacefully during a church service”
