Lindsay Clancy retrial questions now turn on what Kevin Reddington can persuade Judge William Sullivan to do on September 29. After an 11-1 deadlock ended the first trial, the defense is pressing two different legal arguments that could block a second jury from ever hearing the case. Massachusetts Rule 25 allows a judge to enter a required finding of not guilty when the evidence is legally insufficient. Reddington has also said he will argue double jeopardy, claiming there was no manifest necessity for the mistrial after the jury reported that one member acknowledged doubt but would not apply it to the verdict. That juror dispute matters because Sullivan had already reminded the panel that they had to follow the law whether they agreed with it or not. The deadlock instruction also told each juror that the verdict had to reflect his or her own convictions. It separately said that a defendant must be acquitted if reasonable doubt remains. Those commands now sit at the center of the defense fight over what happened in that jury room. The judge refused to remove the holdout during deliberations. Sullivan said the court had to avoid invading the jury's role and found no sufficient showing that the juror had refused to deliberate or follow the law. After the mistrial, foreperson Roni Carlson said the holdout had admitted reasonable doubt before refusing to join the other eleven jurors.
