The Lindsay Clancy case is now fighting on two fronts at once: what happened inside the jury room before the September 4 mistrial, and what Judge William Sullivan can legally do after it. This combined episode begins with our pre-hearing discussion with defense attorney Bob Motta about the lone holdout juror, then moves into special commentary explaining what happened at the September 29 Rule 25 hearing and the fight to un-impound juror information. Jurors who spoke publicly after the mistrial described an 11-to-1 split in favor of finding Clancy not guilty by reason of lack of criminal responsibility. Foreperson Roni Carlson said the holdout acknowledged reasonable doubt but still refused to join that verdict. Juror Nick Dargie said the holdout could not point the group to evidence supporting his position. Those are jurors' accounts, not findings by the court, and they now sit at the center of the defense's double-jeopardy argument. At the September 29 hearing, Kevin Reddington separately renewed a Rule 25 motion asking Sullivan for a required finding of not guilty. Reddington argued the Commonwealth's evidence was legally insufficient and attacked the investigation and physical-evidence record. Prosecutor Shanan Buckingham called that position untenable and pointed back to evidence and stipulations presented at trial. Appellate attorney Martin Weinberg also pressed to unseal jury notes and sidebar material the defense says may matter to whether the mistrial was truly necessary. Prosecutors warned that exposing jury-room material could chill future deliberations. Sullivan did not rule on the Rule 25 request, the double-jeopardy theory, or the access issues that day.
