Lindsay Clancy's September 4 mistrial ended with eleven jurors favoring acquittal on criminal-responsibility grounds and one favoring conviction. That holdout has since become the subject of a second battle, this time over what a defense attorney can demand from a juror after the verdict process breaks down. Kevin Reddington sought an inquiry into Michael Desronvil's jury questionnaire and alleged cellphone use during deliberations. Reporting also surfaced a previously dismissed domestic violence charge and a restraining order involving Desronvil. Neither a dismissed charge nor an order by itself establishes misconduct in the Clancy trial. Desronvil, represented by counsel, has denied having doubts about his verdict. The foreperson gave a different account, saying the holdout acknowledged doubt but still wanted to convict. Judge William Sullivan refused to remove the juror during deliberations and ultimately declared a mistrial. On October 21, he denied the defense request for a post-trial evidentiary hearing. His ruling said information that emerged after the mistrial could not retroactively undermine the finding that a mistrial was necessary. That leaves a separate defense motion asking the court to dismiss the charges on double-jeopardy grounds, with arguments scheduled for November 2. Clancy has pleaded not guilty to murder charges in the deaths of her three children. Her defense argued she was not criminally responsible because of postpartum psychosis; prosecutors argued she understood her actions. Plymouth County prosecutors had not announced whether they would seek another trial. The central tension remains: how can lawyers challenge potential juror misconduct without turning disagreement with one holdout into a punishment for serving?
