Richard Allen’s Delphi appeal asks one basic question in several different forms: what should his jury have been allowed to hear? Defense attorney Bob Motta joins Tony Brueski to break down two pieces of the September 21, 2026 oral argument that go directly to that fight — the alternate-suspect evidence surrounding Brad Holder and the evidence the defense says weakened the State’s case against Allen. Allen’s appellate lawyer Mark Leeman told the Indiana Court of Appeals that Holder had been investigated in 2017 and later became the focus of renewed concern because of a rune-like marking he posted on his hand and other social-media material. Holder has never been charged in the Delphi murders. Judge Frances Gull excluded the defense theory at trial under Indiana’s rule requiring a direct connection between a third party and the crime. The State told the appellate panel that Holder’s work records placed him at a landfill about 25 miles away when Abby Williams and Libby German were confronted. Then the hearing turned back to the evidence against Allen. The defense attacked the unspent .40-caliber cartridge found near the girls and Gull’s decision to exclude former FBI metallurgist William Tobin, who was offered to challenge the reliability of the comparison method. It also argued the jury should have seen the sketch developed with witness Betsy Blair. The State answered that Blair linked the man she saw to the Bridge Guy image and that Allen’s own 2017 statement placed him on the trail that afternoon.
