Caleb Flynn was convicted of aggravated murder and eight other charges in the killing of his wife, Ashley Flynn. Now the focus shifts to Alleigha Botner, the woman prosecutors used to show the affair, the messages, and what Flynn was saying before Ashley died. Botner testified that she and Flynn exchanged more than 100,000 messages during their relationship. Jurors saw texts in which Flynn talked about wanting Ashley gone and discussed killing her. Botner also testified that she deleted a message asking Flynn whether he had been involved after learning Ashley was dead, and prior reporting documented her admission that she lied to the FBI about the affair. That evidence creates an obvious public question: can Ashley Flynn’s family sue Botner? Ohio law makes the answer more complicated. The state abolished civil claims for alienation of affections, so an affair itself does not create liability. A wrongful-death claim would require proof that a defendant’s own wrongful act, neglect, or default legally caused the death. Reading terrible messages, staying in a relationship, or failing to intervene does not automatically meet that standard. Ohio separately makes knowingly failing to report a felony a misdemeanor in some circumstances. Botner has not been charged with that offense or with participating in Ashley’s killing, and no court has ruled that her conduct satisfied those elements. This combined episode follows the evidence the jury actually heard, the messages Botner read aloud, the deletion and FBI testimony, and the much narrower legal path that would have to exist before “she knew” becomes “she is civilly liable.” Listen Anywhere You Get Podcasts: https://pod.link/1655749292 Want to comment and watch this podcast as a video?
