This special Delphi episode is a combination of the “Before the Appeal” commentary followed by a discussion of the appeal hearing with defense attorney Bob Motta. Together, the two parts put the September 21, 2026 oral argument into context: what Richard Allen’s lawyers were asking the Indiana Court of Appeals to undo, what the State said should stand, and which questions from the judges cut straight to the center of the fight. Allen was convicted in November 2024 of murdering Abigail “Abby” Williams and Liberty “Libby” German and was sentenced to 130 years. On appeal, attorney Mark Leeman argued that Allen’s pretrial confinement at Westville Correctional Facility contributed to a severe mental deterioration and that statements made during that period should not have gone to the jury. The State argued that restrictive housing was used for Allen’s safety, was not coercive state action, and that key confessions came when he was lucid. Then came the line that defined the hearing. When the State defended the placement as protection, Judge Nancy Vaidik responded: “You protected him into psychosis.” The panel also pressed the parties on evidence the jury did not hear, including defense challenges involving sketches, firearms evidence, and alternative-perpetrator material. Tony Brueski first lays out the case before the appeal, then sits down with defense attorney Bob Motta to break down what actually happened in the courtroom, what a pointed appellate question does — and does not — mean, and what Allen still has to prove to win a new trial. The three-judge panel took the case under advisement. No ruling was issued at the hearing.
