The goal is civil discovery — subpoenas and depositions to investigate her conduct and determine whether she acted alone. They are seeking over six hundred thousand dollars for the receivership. None of it goes to Murdaugh. Second: Harpootlian took direct aim at Attorney General Alan Wilson over the death penalty. He called it vindictive prosecution — a constitutional bar against escalating charges because a defendant won an appeal. His question was simple and unanswered: what does the AG know now that he did not know five years ago? He accused Wilson of consulting political advisors over career prosecutors. Third: the retrial roadmap. The defense does not expect a trial this year. The preparation includes eight thousand pages of transcript review, new expert witnesses, and a complete discovery scrub. They are pursuing a venue change — but Richland and Charleston are likely off the table because of demographic requirements. Jury selection will require individual questioning of every potential juror. And the evidence. Unknown male DNA under Maggie Murdaugh’s fingernails was collected and never run through CODIS. The defense plans to use it at the retrial, alongside the investigative shortcomings they catalogued — unprocessed tire tracks, overwritten GPS data, and scene procedures that were skipped.
